Background to the legislation:
The Physician Self-Referral Law, called the Stark Law more popularly, was primarily promulgated with the intention of prohibiting physician referrals for certain kinds of stated health services that are payable by Medicare or Medicaid to an entity with which the physician or a person who is from her immediate family has any kind of pecuniary relationship. There are exceptions, in which case this rule does not apply.
On October 30, 2015, the Centers for Medicare and Medicaid Services came up with a revised plan to this law in its document called the 2016 Medicare Physician Fee Schedule, or what is called the “Final Rule”. This plan adds fairly significant changes to the Stark Law.
Reforming healthcare delivery and payment system reform, reducing burdens, ensuring and engendering compliance, and issuance of new exceptions to the Stark Law are some of the purposes of this Final Rule. Except what the Stark Law defines as “ownership or investment interest”, which is about the extent of a physician’s ownership in a physician-owned hospital; all other regulations came into effect from January 1, 2016. The ownership or investment interest clause will become effective on January 1, 2017.
